4. Foiling Equipment and Assumption of Risk

Foiling, wing foiling, surf foiling, prone foiling, SUP foiling, downwind foiling, e-foiling and related watersports involve inherent risks.

By purchasing products from us, you acknowledge that foiling equipment must be used with care, appropriate skill, suitable safety equipment and in suitable conditions.

You are responsible for:

  • using products safely and within your ability;
  • reading and following all manufacturer instructions and safety guidance;
  • checking all equipment before use;
  • assembling equipment correctly;
  • using suitable protective equipment, such as a helmet, impact vest, leash and appropriate wetsuit or flotation equipment where appropriate;
  • complying with local laws, rules, waterway restrictions and safety guidance;
  • ensuring that any product is suitable for your weight, skill level, conditions and intended use.

We are not responsible for injury, loss or damage caused by misuse, incorrect assembly, poor maintenance, modification, unsuitable conditions, impact damage, normal wear and tear, or use outside the manufacturer’s guidance.

Nothing in these Terms limits or excludes our liability where it would be unlawful to do so.

5. Orders

When you place an order on our website, you are making an offer to purchase the goods in your basket.

An order is not accepted by us until we confirm acceptance, dispatch the goods, or otherwise confirm that your order is being processed. We reserve the right to refuse or cancel any order before acceptance.

We may refuse or cancel an order where:

  • the item is out of stock or unavailable;
  • there has been an error in the price, description or availability;
  • payment has not been authorised;
  • we suspect fraud, misuse or unauthorised resale;
  • delivery is not available to your address;
  • we are unable to fulfil the order for any other reasonable reason.

If we cancel an order after you have paid, we will refund any amount paid for the cancelled item.

Prices may change at any time without notice. The price payable is the price shown at the time you place your order, subject to any obvious pricing error.

We reserve the right to correct errors, inaccuracies or omissions relating to prices, product descriptions, availability, promotions, shipping charges or other information.

Payment must be made using one of the payment methods available at checkout. Your order may not be processed until payment has been received and authorised.

7. Stock Availability

Some products may be available in limited quantities or may be supplied to order.

Where an item is marked as pre-order, backorder, special order or estimated delivery, any delivery timescale provided is an estimate only. We will do our best to keep you informed if there are delays, but we cannot guarantee manufacturer or distributor delivery times.

We reserve the right to limit quantities, discontinue products, or withdraw products from sale at any time.

8. Delivery

Delivery options and costs will be shown at checkout where applicable.

We aim to dispatch orders promptly, but delivery times are estimates only and are not guaranteed unless we have expressly agreed this with you in writing.

You are responsible for providing a complete and accurate delivery address. We are not responsible for delays, failed deliveries or additional charges caused by incorrect or incomplete delivery information.

Risk in the goods passes to you when the goods are delivered to you or to a person nominated by you to receive them.

Ownership of the goods passes to you once we have received full payment for the goods and any applicable delivery charges.

9. International Orders, Customs and Import Charges

Where we accept orders for delivery outside the United Kingdom, the customer is responsible for any customs duties, import VAT, taxes, clearance fees, brokerage fees or other charges imposed by the destination country, unless we expressly state otherwise in writing.

You are responsible for ensuring that the products can be lawfully imported and used in your country.

We are not responsible for delays caused by customs checks, import restrictions, unpaid duties, local delivery issues or regulatory requirements.

10. Returns and Cancellations

Our Returns Policy forms part of these Terms and applies to all returns, exchanges, refunds and cancellations.

For online orders, you have the right to cancel your order within 14 days from the day after you receive your goods, unless an exception applies. You then have a further 14 days to return the goods to us.

Returned items must be unused, in their original packaging, complete with all parts and accessories, and in a clean, resellable condition.

Foiling equipment must not have been ridden, assembled, fitted, modified, damaged, scratched, marked, taken on the water or otherwise used if being returned as a change-of-mind return.

Unless the item is faulty, damaged on arrival or incorrect, return postage is the responsibility of the customer.

11. Faulty, Damaged or Incorrect Items

Please inspect your order carefully when it arrives.

If an item arrives damaged, faulty or incorrect, please contact us as soon as possible with your order number, a description of the issue and photographs of the item and packaging.

Where an item is confirmed to be faulty, damaged on arrival or supplied incorrectly, we will provide an appropriate remedy in accordance with your statutory rights. This may include repair, replacement, refund, or reimbursement of reasonable return postage where required.

Damage caused by misuse, incorrect assembly, crashes, impact, modification, unsuitable conditions, poor storage, poor maintenance, water ingress caused by misuse, corrosion, or normal wear and tear is not treated as a fault.

12. Warranty Claims

Manufacturer warranties vary by brand and product.

If you believe a product has developed a fault, please contact us with:

  • your order number;
  • a clear description of the issue;
  • photographs or video showing the issue;
  • photographs of the complete product;
  • details of how and when the issue occurred.

Warranty claims may need to be referred to the manufacturer, distributor or brand representative for assessment.

For warranty assessment claims, the customer is responsible for safely returning the item to us unless we confirm that the issue falls under your statutory rights, or that the item was faulty, damaged on arrival, or supplied incorrectly.

If, after inspection, the item is confirmed to have a fault covered by your statutory rights, we will reimburse reasonable return postage costs or arrange an appropriate remedy.

If the item is found not to be faulty, or the issue is caused by misuse, impact damage, incorrect assembly, modification, poor maintenance, water damage, corrosion, wear and tear, or use outside the manufacturer’s guidance, return postage and any onward shipping costs will remain the customer’s responsibility.

13. Special Order, Custom and Bespoke Items

Some items may be ordered specially for you, customised, personalised, configured to your requirements, or sourced from a supplier specifically to fulfil your order.

Special order, custom, personalised or bespoke items may not be cancellable or returnable unless they are faulty, damaged on arrival, not as described, or your statutory rights apply.

We will tell you where an item is special order, custom or non-standard where reasonably possible.

14. Used, Ex-Demo, Clearance and Sale Items

Used, ex-demo, clearance or sale items may show signs of previous handling, display, use or cosmetic marking where stated at the time of sale.

These items are sold as described. Please read the product description carefully before purchasing.

Your statutory rights are not affected. However, you cannot return an item simply because of a fault, mark, limitation or condition that was clearly described before purchase.

15. Product Compatibility and Assembly

Foiling equipment often uses brand-specific parts, fittings, bolts, tracks, masts, fuselages, wings, stabilisers, batteries, chargers and accessories.

You are responsible for checking compatibility before ordering. We are happy to provide guidance, but final responsibility for compatibility rests with you unless we have expressly confirmed compatibility in writing for your specific equipment and intended use.

You are responsible for correct assembly, tightening, maintenance and inspection of equipment before each use.

We are not responsible for damage, injury or loss caused by incorrect assembly, loose fittings, cross-threading, incompatible parts, over-tightening, under-tightening, modification or failure to inspect equipment before use.

16. Batteries, Electronics and Powered Equipment

Some products, including foil assist systems, e-foil equipment, batteries, chargers, controllers and other electronic products, require particular care.

You must follow all manufacturer instructions relating to charging, storage, transport, waterproofing, maintenance and use.

You must not use damaged batteries, chargers or cables. You must not modify, open, crush, puncture, short-circuit, overcharge, submerge or misuse batteries or electronic components.

We are not responsible for damage or loss caused by incorrect charging, unsuitable chargers, water ingress due to misuse, unauthorised modification, poor maintenance, impact, transport damage, incorrect storage or use outside the manufacturer’s instructions.

Some battery and electronic products may be subject to shipping restrictions. We reserve the right to cancel, amend or restrict orders where shipping restrictions apply.

17. Advice and Guidance

Any advice, recommendations, size guidance, product suggestions or compatibility guidance provided by us is given in good faith based on the information available to us at the time.

Such guidance is not a substitute for professional instruction, safety training, manufacturer guidance or your own assessment of conditions and ability.

You remain responsible for deciding whether a product is suitable and safe for your intended use.

We may sell products manufactured by third-party brands. Manufacturer terms, warranties and instructions may apply to those products.

All content on Justfoils.com, including text, images, graphics, logos, product descriptions, layouts, designs, photography, videos and other materials, is owned by or licensed to Just Foils unless otherwise stated.

You may not copy, reproduce, distribute, modify, scrape, publish or commercially exploit any content from our website without our prior written permission.

Brand names, logos and product names belong to their respective owners.

20. User Reviews, Comments and Submissions

If you submit reviews, comments, photographs, feedback, suggestions or other content to us, you confirm that the content is accurate, lawful and does not infringe the rights of any third party.

  • damage arising from normal wear and tear, impact, corrosion, crashes or water exposure caused by misuse.

For business customers, our total liability for any claim arising from an order shall not exceed the price paid for the relevant product, except where liability cannot be limited by law.

24. Business Customers

If you are purchasing as a business, trade customer, reseller, school, club, organisation or other non-consumer customer, you confirm that you have authority to bind that business or organisation.

Business customers may have different cancellation and return rights from consumers. Unless we agree otherwise in writing, business purchases, trade orders, bulk orders, special orders and bespoke orders are not cancellable or returnable unless the goods are faulty, damaged on arrival, supplied incorrectly, or statutory rights apply.

We are not responsible for failure or delay in performing our obligations where this is caused by events outside our reasonable control.
